Application requirements
1. Educational institutions which apply for setting up schools ran by Sino-foreign cooperation, should have the status of legal entity.
2. Investment could be in form of bankroll, particles, rights of land usage, intellectual property rights and other properties
3. Input of intellectual property rights by each institution should not exceed 1/3 of their own investment. However, this limit can be exceeded if the institution is invited by State Educational Administration Departments, Labor Administration Departments, or local governments at province level.
4. Sino-foreign cooperation school institutions should satisfy the conditions required by "The Law of Education of the PRC "Law of Vocational Education of the PRC "Law of Higher Education of the PRC and other administration law. They should also have the status of legal entity.
5. The following conditions stated by "The Law of Education of the PRC must be satisfied for setting up schools and other educational institutions:
A. Institutional framework and articles
B. Qualified teachers
C. Suitable premises, equipments and facilities for school
D. Essential capital for school operation and stable source of income
6. The following conditions stated by "The Law of Education of the PRC must be satisfied for setting up schools of higher education:
A. Universities or colleges should have great strength in academic teaching and scientific research, high standard and scope of academic teaching, scientific research and have the capability to run undergraduate and postgraduate courses. Specified standards are prescribed by the Department of state.
B. Standards and regulations for setting up other types of higher education institutions should be referred to conditions requested by related departments at province level appointed by the Department of State. Such conditions are based on the principles of the Department of State.
7. The following conditions stated by "The Law of Vocational Education of the PRC must be satisfied for setting up vocational schools:
A. Institutional framework and articles
B. Qualified teachers
C. Suitable premises, equipments and facilities for school
D. Essential capital for school operation and stable source of income
8. To set up Vocational Training institutions, the following conditions must be satisfied:
A. Institutional framework and articles
B. Suitable teachers and management staff for training
C. Suitable premises, equipments and facilities for school
D. Appropriate funds.
9. Sino-foreign cooperative school institutions, established by foreign educational institutions and Sino institutions, to run academic school of higher education, do not need to have the status of legal entity.
10. Standards for setting up Sino-foreign cooperative school institutions should be referred to other educational institutions of the same grade held by state.
Application Procedure
1. Application of warrant for preparation and establishment
- Examination and Approval Department: Education Administration Departments and governments at province level
2. Formal application
Formal application should be submitted within 3 years after getting the warrant. After 3 years, the warrant has to be reapplied. Student recruitment is not permitted during the process of preparation and establishment
